On alcohol specifically

Shopify states that brands “must acquire and maintain all necessary licenses” and must have “effective age verification practices so that alcohol products can’t be purchased or received by people who are under the age of 21”. Shopify does not do this for you. The store has to be built so it cannot sell to the wrong person or ship to the wrong state.

On traceability

The FSMA 204 deadline sounds distant. The data work behind it is not quick. Brands selling foods on the list should plan the 3PL and ERP data flow now, not in 2028.

FDA announced its intention to extend the compliance date from 20 January 2026 to 20 July 2028 on 20 March 2025; Congress then directed FDA not to enforce the rule before that date.
