Buffalo's combined sales tax rate is 8.75% in 2026: New York's 4% state rate plus Erie County's 4.75%. No cities or towns in Erie County add their own tax, so the same 8.75% applies across the county, including Tonawanda, Hamburg and Orchard Park.

New York taxes by delivery address, so a New York City order is taxed at 8.875% and a Buffalo order at 8.75%. Shopify Tax applies the right rate from each address.

Is clothing taxed in Buffalo, New York?

Partly. Clothing and footwear under $110 per item are exempt from New York's 4% state tax. But Erie County doesn't exempt them, so Buffalo orders still carry the 4.75% county tax. New York City exempts the same items completely. Items at $110 or more are taxed at the full rate in both places.

This is easy to get wrong in both directions. A store that treats all clothing under $110 as tax-free under-collects on Buffalo orders, while one that charges the full rate over-collects. Each product needs the right tax category in Shopify.

When does an out-of-state seller collect New York sales tax?

Only after passing both of New York's tests over the previous four sales tax quarters. Sales into the state must exceed $500,000, and transactions must exceed 100. If you also sell through a marketplace that collects New York tax, ask your accountant how those sales count. Because both conditions must be met, New York's threshold is one of the highest in the country.

That means a Canadian or out-of-state brand can sell meaningfully into New York before registering. Track both numbers, since the transaction count can lag well behind sales for brands with high order values.
